You Have Been In A Motor Vehicle Accident, Now What?

It is very important to know that Ontario has a complicated system that defines the process of compensation and dispute resolution available to individuals who were injured in an accident. Considering the changes that were implemented for accidents after September 1, 2010, an entitlement to damages depends on the type of insurance coverage the insured purchased or on the type of insurance that was purchased by the at-fault driver.

It is extremely important that you retain an experienced legal representation to help you recover all benefits and damages available to you.

If you are a pedestrian, bicyclist, passenger or driver of a vehicle, or passenger on a bus or streetcar, you may be able to make an Accident Benefits Claim that covers your rehabilitation, income loss, medical and other expenses.


ACCIDENT BENEFITS

Ontario’s standard Auto Insurance policy provides you with a number of benefits if you were injured in a Motor Vehicle Accident, regardless of who is AT FAULT. These ACCIDENT BENEFITS are governed by the Statutory Accident Benefits Schedule (SABS), which is a Regulation made under the Insurance Act of Ontario.

If you are injured in an accident, you can receive benefits from either:

  • your own insurance company, or
  • the insurance company of the vehicle in which you were a passenger, or
  • the insurance company of the other vehicle involved in the accident

Accidents Benefits include:

  • Income Replacement;
  • Non-earner;
  • Caregiver;
  • Housekeeping;
  • Medical;
  • Rehabilitation;
  • Attendant Care, and other related expenses.

WHAT YOU MUST DO AFTER A CAR ACCIDENT:

  • Call the Police: Ensure that the police have been informed about the accident
  • Record contact information
  • Record the names and addresses of the other motorists involved in the accident, along with the names and addresses of any witnesses
  • Keep receipts, dates and records of all related expenses for both you and your family members (i.e. parking, hotel costs, days off work, time spent caring for the injured person, etc.)
  • Inform your family doctor of the accident and your injury
